Terms of Use

In this Agreement the following terms shall have the following meanings:

“Account”

Collectively the personal information, payment information, and credentials used by Users to access paid content and services on the Websites.

“Content”

Any text, graphics, images, audio, video, software, data compilations, and any other form of information that appears on or forms part of the Websites.

“Facilities”

Collectively any online facilities, tools, services, or information that Ascent Leadership Institute Inc makes available through the Websites, now or in the future.

“Services”

The services available through the Websites, including recorded courses, live events, healing sessions, the Sanctuary App, and practitioner tools.

“Payment Information”

Any details required for the purchase of Services, including but not limited to credit and debit card numbers and other payment credentials.

“Premises”

Our place of business at 8550 W Desert Inn Rd Ste 102166, Las Vegas, NV 89117-4401, USA.

“Sanctuary App”

The AI-powered healing application available at sanctuary.phoenixblessing.com.

“User / Users”

Any third party that accesses the Websites and is not employed by Ascent Leadership Institute Inc in the course of their employment.

“Website / Websites”

phoenixblessing.com, sanctuary.phoenixblessing.com, and academy.phoenixblessing.com, and any sub-domains unless expressly excluded by their own terms.

“We / Us / Our”

Ascent Leadership Institute Inc, a company incorporated in the United States of America, located at 8550 W Desert Inn Rd Ste 102166, Las Vegas, NV 89117-4401, USA.

Persons under the age of 18 should use the Websites only with adult supervision. Payment Information must be provided by or with the permission of an adult.

These Terms also apply to customers procuring Services in the course of business.

• 4.1PhoenixBlessing is a trademark of a healing technique developed by Hiroyuki Miyazaki, CEO of Ascent Leadership Institute Inc. All rights reserved 2020 by Hiroyuki Miyazaki and Ascent Leadership Institute Inc.
• 4.2No part of any course, workshop, seminar, or event may be reproduced, distributed, or transmitted in any form or by any means — including photocopying, recording, or other electronic or mechanical methods — without the prior written permission of the Author.
• 4.3Only PhoenixBlessing Certified Instructors are authorized to teach PhoenixBlessing seminars and workshops. Only PhoenixBlessing Certified Practitioners are authorized to practice the PhoenixBlessing technique with clients. To become certified, you must complete the designated training offered by a PhoenixBlessing Certified Instructor or by Hiroyuki Miyazaki directly.
• 4.4You are not authorized to use the trademarks or logomark of PhoenixBlessing without express written permission.
• 4.5The approaches and techniques described in our Services are not intended to supplement or substitute professional medical care or treatment. If you are experiencing a physical or mental health condition, please always seek professional help first.
• 4.6While Ascent Leadership Institute Inc has used its best efforts in preparing its Services, it makes no representations or warranties with respect to the accuracy or completeness of the content and specifically disclaims any implied warranties of merchantability or fitness for a particular purpose.
• 4.7Neither Ascent Leadership Institute Inc nor its instructors can be held responsible for any loss, claim, or damage arising out of the use or misuse of the techniques or suggestions provided, or for the failure to seek appropriate professional advice.

• 5.1All Content on the Websites, unless uploaded by Users, including but not limited to text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code, and software, is the property of Ascent Leadership Institute Inc, our affiliates, or relevant third parties. By using the Websites you acknowledge that such material is protected by applicable United States and international intellectual property laws.
• 5.2You may not reproduce, copy, distribute, store, or re-use material from the Websites unless otherwise indicated or unless given our express written permission.

• 6.1Unless otherwise indicated, all intellectual property rights in product images and descriptions belong to their respective manufacturers or distributors.
• 6.2You may not reproduce, copy, distribute, store, or re-use such material without the permission of the relevant rights holder.

The Websites may contain links to third-party sites. Unless expressly stated, these sites are not under the control of Ascent Leadership Institute Inc. We assume no responsibility for the content of such websites and disclaim liability for any loss or damage arising from their use.

When using any communication feature on the Websites, you must not:

• 9.1Use obscene or vulgar language
• 9.2Submit content that is unlawful, abusive, threatening, harassing, defamatory, or discriminatory
• 9.3Submit content intended to promote or incite violence
• 9.4Impersonate employees, representatives, or other users of Ascent Leadership Institute Inc
• 9.5Use our systems for unauthorized mass communication such as spam or junk mail

Ascent Leadership Institute Inc reserves the right to monitor and retain copies of communications made through our systems.

• 10.1To access paid Services and certain features of the Websites and Sanctuary App, you are required to create an Account. By creating an Account, you represent and warrant that all information submitted is accurate and truthful, that you have permission to submit any Payment Information provided, and that you will keep this information current and accurate.
• 10.2We recommend that you do not share your Account credentials. We accept no liability for losses arising from Account details shared by you.
• 10.3If you believe your Account has been accessed by an unauthorized party, contact us immediately at [email protected] to suspend your Account.
• 10.4Your username must not violate these Terms or applicable law.

• 11.1Either Ascent Leadership Institute Inc or you may terminate your Account. If we terminate your Account, you will be notified by email with an explanation. We reserve the right to terminate without providing reasons in cases of breach of these Terms.
• 11.2If we terminate your Account, any pending orders or payments will be cancelled.

• 12.1We make every effort to ensure that descriptions of Services correspond to the Services provided. We are not responsible for minor variations where the core Service is not affected.
• 12.2All pricing on the Websites is correct at the time of publication. We reserve the right to change prices and alter or remove special offers at any time.
• 12.3In the event that a price changes between placement of an order and processing of payment, the price at the time of the order will apply.

• 13.1Your order constitutes a contractual offer that we may, at our sole discretion, accept. Our acceptance is indicated by sending you an order confirmation email. A binding contract exists only after this confirmation is sent.
• 13.2Order confirmations will include: confirmation of the Services ordered; full pricing including applicable taxes; relevant dates and times; and access credentials or instructions.
• 13.3If we do not accept your order, no payment will be taken. Any sums paid will be refunded within 14 calendar days.
• 13.4Payment for Services will be taken via your chosen payment method upon order confirmation, and at the applicable billing cycle for subscription Services.
• 13.5Ascent Leadership Institute Inc will use all reasonable endeavours to provide Services with reasonable skill and care, commensurate with industry best practice.
• 13.6Ascent Leadership Institute Inc provides support via email at [email protected]. We make every effort to respond in a timely manner but do not guarantee a specific response time.

• 14.1Consumers within the European Union have a statutory 14-day cooling-off period beginning from the date of order confirmation. To cancel during this period, contact us at [email protected].
• 14.2If Services begin within the 14-day cooling-off period at your express request: (14.2.1) If Services are fully performed within the cooling-off period, you lose the right to cancel once complete. (14.2.2) If you cancel after Services have begun but are not complete, you will be charged proportionally for Services already provided. Refunds will be issued within 14 calendar days of cancellation.
• 14.3Cancellation after the 14-day cooling-off period is subject to the specific terms governing those Services and may be subject to a minimum contract duration.

• 15.1Practitioner membership is available to certified PhoenixBlessing practitioners on a monthly subscription basis.
• 15.2Membership grants access to practitioner tools, the practitioner directory listing, community resources, and continuing education content as described on the membership page.
• 15.3Membership is active only while the subscription is current. Cancellation of the subscription suspends practitioner directory listing and access to practitioner-only tools.
• 15.4Certification validity is maintained while membership is active. Practitioners who cancel membership and later reactivate retain their certification status subject to any applicable renewal requirements at the time of reactivation.

Use of the Websites is also governed by our Privacy Policy, incorporated into these Terms by reference.

• 18.1The Websites and their content are provided on an “as is” and “as available” basis without any warranty of any kind, express or implied.
• 18.2Ascent Leadership Institute Inc does not warrant that the Websites will be uninterrupted, error-free, or free of viruses or other harmful components.
• 18.3To the fullest extent permitted by law, Ascent Leadership Institute Inc excludes all liability for loss or damage arising from use of the Websites or their content.

These Terms are governed by and construed in accordance with the laws of the State of Nevada, United States of America. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nevada.

Ascent Leadership Institute Inc reserves the right to update these Terms at any time. Changes will be posted to this page with an updated date. Your continued use of the Websites after changes are posted constitutes acceptance of the updated Terms.
